OFFICIAL RULES

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR ODDS OF WINNING. VOID WHERE PROHIBITED BY LAW.

1. SPONSOR

The Bear Mountain “Be the Bear” Sweepstakes (the “Promotion”) is sponsored by Bear Mountain Forest Products, Inc.(“Sponsor”).

This Promotion is not sponsored, endorsed, administered by, or affiliated with Instagram, Facebook, TikTok, YouTube, or any other social-media platform.

2. PROMOTION PERIOD

The Promotion begins at 12:00:00 a.m. Mountain Time on September 24, 2026, and ends at 11:59:59 p.m. Mountain Time on October 25, 2026 (the “Promotion Period”).

Sponsor's computer is the official timekeeping device.

3. ELIGIBILITY

The Promotion is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older and the age of majority in their state of residence at the time of entry.

Employees, officers, directors, and representatives of Sponsor, its parent companies, subsidiaries, affiliates, advertising and promotion agencies, prize suppliers, and their immediate family members and household members are not eligible.

4. HOW TO ENTER

During the Promotion Period, eligible participants must:

1. Create an original photo or video featuring their signature BBQ dish or cook;
2. Use an eligible Bear Mountain product in preparing the featured dish or cook;
3. Clearly show the Bear Mountain product used;
4. Post the photo or video to an eligible public social-media account;
5. Tag @BearMountainBBQ in the post; and
6. Include #BeTheBear.

Eligible Bear Mountain products include pellets, wood chips, wood chunks, and charcoal.

The Entry must remain publicly viewable through the end of the Promotion Period and until the applicable winner has been verified.

Limit one (1) Entry per person.

Private accounts are not eligible because Sponsor must be able to verify the Entry.

By submitting an Entry, the entrant acknowledges and agrees to these Official Rules, including Sponsor's rights to use the Entry as described below.

5. ENTRY REQUIREMENTS

Each Entry must:

• Be original and created by the entrant;
• Feature a BBQ dish or cook prepared by the entrant;
• Use and clearly show an eligible Bear Mountain product;
• Comply with all applicable social-media platform rules;
• Not contain unlawful, obscene, defamatory, threatening, hateful, or otherwise objectionable material;
• Not contain nudity or sexually explicit material;
• Not promote illegal activity;
• Not infringe any third-party copyright, trademark, publicity, privacy, or other rights;
• Not contain another person's personal information;
• Not falsely imply endorsement by any person, brand, or organization; and
• Not contain false or misleading claims about Bear Mountain or another product.

Sponsor reserves the right to disqualify any Entry that does not comply with these Official Rules.

Entries generated through bots, scripts, automated systems, or other unauthorized means are void.

6. RANDOM DRAWING

Following the Promotion Period, Sponsor or its designated administrator will conduct a random drawing from all eligible Entries received during the Promotion Period.

The drawing will occur on or about October 27, 2026.

There will be twelve (12) total potential winners.

The odds of winning depend on the number of eligible Entries received.

Selection is random; an Entry is not judged based on photography, cooking skill, popularity, number of followers, or number of likes.

7. PRIZES

There are three prize packages, with twelve total winners.

One (1) Pitmaster Prize Package

• $1,000 retailer gift card toward a new grill, smoker, or BBQ upgrade; and
• One year's supply of Bear Mountain product — 12 bags.

One (1) Level Up Prize Package

• One masterclass with World Champion Grilling Pro Brian Gurney;
• One year's supply of Bear Mountain product — 12 bags; and
• One Brian Gurney/Bad Bones BBQ prize package, including a collection of rubs, sauces, and Bloody Mix.

The Brian Gurney masterclass is subject to mutually agreed scheduling, availability, location, duration, and reasonable restrictions. Travel, transportation, lodging, meals, and other expenses are not included unless specifically stated by Sponsor.

Ten (10) Playmaker Prize Packages

Each includes:

• $100 retailer gift card;
• Bear Mountain Holiday Blend, Tailgating Blend, and Gourmet Blend; and
• One Bear Mountain limited-edition hat.

The approximate retail value of each prize package will be determined by Sponsor.

Prizes are non-transferable and no cash substitution is permitted, except that Sponsor reserves the right to substitute a prize or prize component with one of equal or greater value if necessary.

All federal, state, and local taxes and all other expenses associated with accepting or using a prize are the sole responsibility of the winner.

8. WINNER NOTIFICATION

Potential winners will be contacted through the social-media account associated with their winning Entry and/or the contact information provided to Sponsor.

Potential winners may be required to complete and return an Affidavit of Eligibility, Liability Release, and Publicity Release, where permitted by law, and any other documentation requested by Sponsor.

If a potential winner cannot be contacted, fails to respond within five (5) calendar days, fails to provide requested documentation, is determined to be ineligible, or otherwise fails to comply with these Official Rules, the prize may be forfeited and awarded to an alternate potential winner selected at random.

9. USE OF ENTRIES

By entering, you understand and agree that Sponsor may share and use your Entry for Bear Mountain marketing and promotional purposes, whether or not you are selected as a winner.

Sponsor may feature, repost, publish, display, reproduce, edit, modify, adapt, or otherwise use an Entry, including the entrant's name, social-media handle, likeness, voice, photograph, video, recipe, statements, and other content associated with the Entry.

Such use may include, without limitation:

• Bear Mountain social-media accounts;
• BearMountainBBQ.com and other Bear Mountain websites;
• Email and newsletters;
• Organic and paid social media;
• Digital advertising and other online advertising;
• YouTube and other video channels;
• Retailer and e-commerce marketing;
• Print and promotional materials;
• Public relations;
• Recipe collections and cookbooks;
• Downloadable content;
• Contest and campaign recap materials; and
• Any other marketing or promotional channels now known or later developed.

Sponsor may use an Entry with or without identifying the entrant and may crop, resize, edit, caption, modify, adapt, or combine the Entry with other content.

Entrants will not receive additional compensation for these uses.

10. LICENSE TO SPONSOR

By submitting an Entry, entrant grants Sponsor and its designees a worldwide, royalty-free, non-exclusive, perpetual, irrevocable, transferable, and sublicensable license to reproduce, publish, display, distribute, transmit, broadcast, edit, modify, adapt, create derivative works from, and otherwise use the Entry, in whole or in part, in any media or format now known or later developed, for advertising, marketing, promotional, editorial, commercial, and other legitimate business purposes.

Entrant represents and warrants that:

• The Entry is original to entrant or entrant has obtained all necessary rights;
• Entrant has permission from any identifiable individuals appearing in the Entry;
• The Entry does not infringe any third-party rights;
• Entrant has the right to grant Sponsor the license described above; and
• The Entry complies with these Official Rules and applicable law.

 

11. PUBLICITY

Except where prohibited by law, acceptance of a prize constitutes permission for Sponsor and its designees to use the winner's name, social-media handle, photograph, likeness, voice, statements, and Entry for advertising, marketing, promotional, and publicity purposes without additional compensation.

12. SOCIAL-MEDIA DISCLAIMER

This Promotion is not sponsored, endorsed, administered by, or affiliated with Instagram, Facebook, TikTok, YouTube, or any other social-media platform.

By participating, entrants release the applicable social-media platform from any liability arising from or related to the Promotion.

13. RELEASE OF LIABILITY

By participating, entrants agree to release and hold harmless Sponsor, its parent companies, subsidiaries, affiliates, agencies, prize suppliers, retailers, and their respective officers, directors, employees, representatives, and agents from claims, liabilities, damages, losses, costs, and expenses arising out of or relating to participation in the Promotion, submission of an Entry, acceptance or use of a prize, participation in prize-related activities, or violation of these Official Rules.

14. GENERAL CONDITIONS

Sponsor reserves the right to cancel, suspend, modify, or terminate the Promotion if fraud, technical failures, unauthorized intervention, human error, or any other circumstance beyond Sponsor's reasonable control compromises the integrity or proper functioning of the Promotion.

Sponsor may disqualify any person who tampers with the Entry process, violates these Official Rules, or acts in a fraudulent, disruptive, or unsportsmanlike manner.

Sponsor's decisions are final and binding, subject to applicable law.

15. LIMITATION OF LIABILITY

Sponsor is not responsible for lost, late, incomplete, inaccurate, stolen, delayed, misdirected, or undeliverable Entries; technical failures; network or server problems; social-media outages; unauthorized access; or any other technical or human error associated with the Promotion.

16. GOVERNING LAW

The Promotion is subject to applicable federal, state, and local laws and regulations.

Except where prohibited by law, the Promotion and these Official Rules shall be governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
